These Terms ("Terms") govern your access to and use of Quell (the "Service"), including our website, web application, and related pages (collectively, "Quell," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.
1. Who we are Quell is operated by Quell Inc. Contact: hello@thequellapp.com
2. Eligibility You must be at least 18 years old (or the age of majority where you live) to use the Service.
3. Accounts You are responsible for your account credentials and for activity under your account. You agree to provide accurate account information and keep it current.
4. License and acceptable use We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You agree not to:
- copy, modify, reverse engineer, or attempt to extract source code from the Service
- misuse, disrupt, or attempt unauthorized access to the Service or related systems
- use the Service in violation of law or in a way that infringes another person's rights
5. Purchases, pricing, and payment processing Quell currently offers a paid annual training plan (for example, $365/year as shown at checkout). Payments are processed by third-party payment processors such as Stripe. We do not store full payment card numbers.
6. Access and delivery After successful payment, access is delivered digitally through your account. Access level and duration are described on the checkout page at time of purchase.
7. 90-day guarantee and refunds Quell offers a 90-day guarantee for the paid training plan. Train for 90 days and, if it does not work for you, contact hello@thequellapp.com to request a refund. Refunds are issued to the original payment method when possible.
8. Health and medical disclaimer Quell provides educational content and guided training for nervous-system regulation and behavior change. Quell is not medical care and does not provide medical advice, diagnosis, or treatment. Do not use Quell as a substitute for professional medical or mental health care.
9. Intellectual property The Service, including content, training materials, trademarks, and branding, is owned by Quell or our licensors. Except for the limited license above, no rights are granted.
10. Third-party services We may rely on third-party providers for services such as payments, authentication, hosting, and analytics. Their services may be subject to their own terms and privacy policies.
11. Disclaimers The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability To the maximum extent permitted by law, Quell will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues.
13. Indemnification You agree to indemnify and hold harmless Quell and its affiliates, officers, employees, and agents from claims, liabilities, damages, and expenses arising from your use of the Service or violation of these Terms.
14. Termination We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time.
15. Governing law These Terms are governed by the laws of British Columbia, Canada.
16. Changes to these Terms We may update these Terms from time to time. If we make material changes, we will update the effective date and post the updated Terms.
